Do I need probate?

It depends on how your assets are titled. Probate is generally required for assets held in your name alone with no beneficiary, but assets in a living trust, jointly owned property, and accounts with named beneficiaries usually skip it. Many states also offer simplified probate for small estates. If most of your property passes through trusts and beneficiary designations, your estate may avoid probate almost entirely.
