Question

What records are needed for a charitable gift from an estate?

The situation is that the estate plan includes gifts to charity through a will, trust, or retirement account. The situation is that the executor also has to distinguish a charitable transfer from ordinary administration expenses. What I am dealing with is that I want to know what should be checked before the return is finalized.

Keep the governing document, proof of the charity's status, receipts, valuations, and distribution records. Federal and state systems are separate, so the executor or beneficiary should check the current rules that apply in NY and any other state connected to the estate. How the item is taxed can depend on timing, beneficiary status, ownership, basis, and whether the payment is treated as principal or income. For the filing analysis, charitable gifts at death can reduce the taxable estate when made to qualifying organizations and properly documented.
