Question

Is avoiding probate worth it for a simple estate?

I have a fairly simple estate and no family conflict. I am considering a trust mainly because people say probate should always be avoided. Is avoiding probate worth the extra documents, retitling, and ongoing maintenance for every estate, or are there situations where a straightforward probate process is perfectly reasonable?

The value depends on local probate cost, privacy concerns, real estate locations, family needs, and the complexity of the plan. As part of the legal review, probate avoidance is usually achieved by coordinating ownership, beneficiary designations, transfer on death tools, and trusts. For the issue described here, avoiding probate is not the only goal because creditor protection, taxes, control, and family fairness also matter. Professional guidance becomes more important when the plan touches family dynamics, property, taxes, or a business.
