Question

Can an executor waive their fee?

At the moment, I am serving as executor and may receive a fee for the work in addition to my inheritance. At the moment, I want to keep the compensation, reimbursements, and beneficiary distribution clearly separated for tax purposes. At the moment, there is roughly $185,000 involved in my situation, which is large enough that I do not want to guess about basis, income, deductions, or filing requirements.

An executor may be able to decline compensation, but timing and documentation matter. For the filing analysis, executor and personal representative fees are generally taxable compensation to the recipient, even when the recipient is also an heir. Preserve the records that establish who owned the item, when it changed hands, and what values were used, then ask a CPA, enrolled agent, or tax attorney to validate the taxpayer, form, basis, and deadline.
