What is a residuary estate?

The residuary estate is everything left over after specific gifts, debts, taxes, and expenses have been paid out. Your will usually includes a residuary clause naming who receives this remainder, which catches anything you didn't specifically assign. Without that clause, leftover assets could pass under state intestacy law instead of to whom you intended. It's an important catch-all that keeps your whole estate covered.
